Builders and Subcontractors Should Have It In Writing
It is very important that every subcontractor who works on your house is doing so under written agreement.
The agreement must specify work to be performed, price to be paid for the work, materials to be provided, an estimated completion time, and length of warranty.
Many subcontractors, particularly those who provide the major systems (electrical, plumbing, heat & air) will present to you, on their own letterhead, a written proposal which specifies all terms and conditions.
As long as their proposal is complete with all of the items mentioned above, I’m perfectly willing to use their form in lieu of any other contract.
Signed and dated by both parties, this document should be all that you need.
Other subcontractors don’t offer written proposals.
They may be accustomed to working by verbal agreement with builders with whom they have a long term, established relationship.
That’s fine for them, but not good enough for you.
A simple contract is needed and you should be prepared to provide one.
Make certain that the contract is filled out completely and signed and dated by both parties.
Laws vary by state. You should have an attorney look at this sample contract to make sure that it provides for all of your needs.
Whatever form you use, keep it one page, simple, and free of legalese.
